The Cabinet of Ministers has updated the criteria for reserving military personnel during mobilization and wartime. The grounds for an enterprise to obtain the status of "critical importance" have also been reviewed.
This is outlined in the CMU Resolution No. 1332 dated November 22, 2024.
The document states that workers holding positions at a critical enterprise or institution, whose monthly salary in each month of the last reporting period (quarter) is below the minimum wage in the country (8,000 UAH as of April 2024 – mind), multiplied by a coefficient of 2.5, are not subject to reservation. This means 20,000 UAH.
For state and municipal enterprises, where more than 50% is owned by the state or is in communal ownership, as well as economic companies that are half-owned by the state – they must pay their employees at least the average salary in the region for the IV quarter of 2021.
Reservations of military personnel will be carried out through "Diia" using electronic lists. To obtain the status of "critical importance," an enterprise must provide a certificate confirming the absence of tax and social insurance debt. Considering the needs of local communities, the "critical" status will be coordinated with the Ministry of Economy and the Ministry of Defense. Authorities determining critical enterprises will be required to monitor their compliance with the criteria on a quarterly basis.
The resolution comes into effect on December 1, 2024. Any deferrals granted before this time will remain in effect until the end of the period for which they were issued, but no later than February 28, 2025.
