Scheduled inspections of construction product quality are set to begin in Ukraine.

New fines and enforcement mechanisms have also been established to ensure the swift removal of products in the event of violations.

In the near future, the first planned inspections of construction products will commence in Ukraine.

This was reported to the Interfax-Ukraine agency by Natalia Duzhilova, the Deputy Head of the State Inspection of Architecture and Urban Planning.

“The new European regulation is a process of evolutionary changes in legislation. The main innovations focus more on issues of sustainable development, ecology, digitalization, and safety in the provision of construction products to the market. Most of them will come into force in 2026. Our task is to fully implement our current law, which means training our manufacturers to prepare declarations for construction products, creating an effective quality infrastructure, including modern laboratories that would ensure testing of our products. Only after that will we proceed to evolutionary changes in the regulatory framework to ensure the harmonization of legislation with European standards,” Duzhilova stated.

As reported by Interfax-Ukraine, the law “On the Provision of Construction Products on the Market,” which ensures the implementation of the provisions of EU Regulation 305/2011 regarding the quality of construction products, was adopted in 2020 and came into effect in 2023.

At the same time, as reported by the Confederation of Builders of Ukraine, on January 7, 2025, Regulation (EU) 2024/3110, which was issued on November 27, 2024, will come into force instead of Regulation 305. However, Ukraine has not yet fully complied with the requirements of Regulation 305. As of January 2025, the necessary quality infrastructure is still not fully in place in Ukraine, which prevents comprehensive testing of construction products. The return of market surveillance and planned inspections will stimulate the creation of quality infrastructure.

As clarified by the CBU, Regulation 2024/3110 introduces new requirements regarding sustainability and environmental efficiency. In particular, there is a greater emphasis on the impact of construction products on the environment, which will encourage manufacturers to disclose life cycle assessments and carbon footprints. It also promotes the creation of products that facilitate reuse, recycling, and effective resource utilization.

One of the key updates is the introduction of digital product passports. These will become mandatory for construction products, ensuring the availability of essential product data in digital format throughout their life cycle.

The regulation includes measures to simplify compliance procedures for small and medium-sized enterprises (SMEs), including more accessible technical documentation and testing requirements.

Simultaneously, the new regulation enhances market surveillance, providing authorities with expanded tools for monitoring products placed on the market and ensuring compliance with requirements. New penalties and enforcement mechanisms have also been defined to guarantee the swift withdrawal of products in case of violations.

At the same time, the information requirements have been expanded: manufacturers are obliged to provide more detailed information about products, including data on environmental efficiency, safety, and recyclability.

Some articles of Regulation (EU) 2024/3110 have already come into effect; however, the application of most provisions will begin on January 8, 2026, and some will begin on January 8, 2027, the agency reports.

Additionally, developers are announcing plans for new projects. However, there are already certain challenges in this market, particularly a shortage of domestic construction materials. This shortage is caused not only by the war in Ukraine. Nonetheless, in the post-war period, construction will become one of the key factors for economic growth.
