Corrupt officials may evade prison by striking a deal with investigators.

The Verkhovna Rada has approved the draft law No. 12039 regarding the release of corrupt officials from prison through agreements with the investigation. A total of 263 deputies voted "in favor."

This was reported by MP Yaroslav Zheleznyak.

"This text has the support of both the SAP and NABU, and it also aligns with our international obligations," he noted.

The draft law specifically includes:

  • a new article allowing for a reduced prison sentence in cases of cooperation with the investigation through the disclosure of accomplices and compensation for damages, less than what the code requires (for example, 5 years instead of 8 years);
  • court permission to impose a significant additional fine – up to 102 million UAH for particularly serious crimes, and over 4 million UAH for serious crimes;
  • court permission to confiscate the property of the individual involved if this type of punishment is agreed upon.

"However, this tool cannot be generally applied to the organizers of schemes unless such an organizer exposes another organizer," the MP explained.

He also added that in cases of lesser offenses and when large schemes without accomplices are not involved, a reduced sentence may be granted to an individual who fully compensates for damages, pays the fine, and may additionally face confiscation.

"The law needs to be signed by October 31 to secure funding under the Ukraine Facility Plan. This amounts to 4 billion euros," Zheleznyak emphasized.
